    Tim I thank you for all your help on this forum. You always reply back with a positive message.
    I have not been around for a few weeks. I had a wound on the bottom of my foot, that I and the doctors have been trying to get to heal. I had surgery a few weeks ago for an amputation of my toe. I am healing and recuperating at home. I am now on temporary disability. I have not been able to send out my message for Wells Fargo to reply to me about the modification. I checked yesterday, and still no reply.

    I am accepting of my foot and will get better and get to work again. The doctor gave me till November or longer if necessary. I do not know what to do next. I am tired of the ignoring of the e-mail and all the banks getting away with the destruction of America and it’s working class.

    I have asked our Servicer Manger for your bank to open an investigation regarding the lack of response from your lender.

    You concentrate on recovering. We are still working on things here.

    Tim I am doing better these days. I will get to see my Dr. in November. He seems to think that all is going well and the whole thing is going better then expected. I am still requesting a response from Wells Fargo on the web site. Still no reply. I know you said you were going to have them look in to it. Is there ant news?
    I am worried that they will show up and ask me to leave and all our stuff will be left in here. I do not want to be unprepared.
    Please let me know of any update or news or if I need to call and speak to some one.

    Hello john ontiveros,

    First and foremost your fears that “they will show up and ask me to leave and all our stuff will be left in here” are totally unfounded. It simply doesn’t work that way, so please try to put it out of your mind. You cannot be foreclosed upon much less evicted without being notified in advance of the appropriate legal action required.

    I will make another inquiry with the Servicer Manager on your behalf to see what I can find out for you.

    Hello Tim and thanks for all the help.

    W.F. did reply to me through the NACA site. They said that we were removed because we did not sent them the required documents. So they are now requesting the same stuff sent months ago. I once again sent them all requested information. This was in my file on the 14th of Oct. No response from them. Came home today and on the door of our home is these documents from NBS Default Service,LLC Telling us that the sale date for our property is Nov12 2013 at the court house in San Jose. It is really embarrassing to come home and see that our whole neighbor hood can see this notice.

    Is this the date I need to put down on the NACA site under auction date?
    I have received other notices from these guys in the mail only

    I have already entered the auction date into your file for you. At least their denial and explanation now give us a clear course of action.

    We need to update the file and resubmit the proposal, making sure it contains the requested information. Please provide proof of income for the last thirty days plus the documents Wells Fargo asked for, and email me when you have submitted them to your file. We will arrange to get a new proposal created and submitted for you then.

    Creating the new proposal is crucial because federal law provides you protection from foreclosure when there is an active modification proposal in front of the servicer. Without the modification proposal, the bank can ignore any and all requests to halt the auction.

    Please make sure to let me know as soon as the documents have been sent.

    Tim we have sent via fax to our account the information you have requested,
    also on the 14th of Oct I sent the WF the following 3 months check statement,
    Debbie rental agreement and a printed copy of NACA proposal with signature.
    Let me know if any thing else is needed.

    I have went to my page at Naca and it say’s auction not postponed. I want to know if there is any thing else you need or should I call some one else.
    I am scared and only have a couple of weeks before all is said and done.
    Please let me know as soon as posible.

    Hello john ontiveros,

    Actually in this business a couple of weeks is forever. The request for postponement or cancellation of the auction can’t even be made more than 14 days before foreclosure.

    I’m going to ask you to call our Housing Counseling section at 606-230-6222 to make sure the file gets resubmitted. We need to do that as part of the process to stop the sale.

    We spoke to them on the 25th and we have an appointment for this Monday for a councilor
    We also received a call from the NACA office to assist us and he left his name and extension. I will keep you updated

    I was able o get a hold of a councilor and get all our documents in. I checked the web site and it has been sent over to W.F. and it is in review. While speaking to a advocate at NACA they asked if we had a plan B. I said no.
    A realtor called me up and said that he could help me postpone the auction.
    He said to resubmit my loan mod to W.F. and they would halt the auction , and that would last for 30 days. He then said the the guy at W.F. is a friend of his and would help us.
    He then wants me to pay no property tax and to stop paying the second. witch is on time and good.
    He wants me to open a second checking account and put all income money there and only report the Chase account. He has instructed me to not talk of any of this on the W.F. work line when they call.

    He said he will put our home on the market and see what kind of hits we get. If not big enough then we go to short sale. He believes he can get this done so the we can be in house until May or June.

    I guess this is plan B

    Too much secrecy and unscrupulous activity.
    Once again I will do the footwork and continue to pray to God for the right direction and for His will to be done.

    From what you describe, this “realtor” who called you out of the blue and and has a “friend” at Wells Fargo is most likely perpetrating a scam designed to cheat you out of your home rather than save it.

    He is asking you to commit mortgage fraud, a federal crime, by having you open a second checking account and deliberately not report the income. While you are dealing with that after it is eventually caught, he steals your home from you by paying the delinquent taxes when the county forecloses for non-payment, leaving him owning the home free and clear for next to nothing and you still holding the bag on both the first and second loans, which you still owe.

    You are wise in being suspicious. It’s a scam. RUN away from this guy! In fact, I would strongly suggest you report him to your local FBI office. In fact, please email me the information on this person also. Our legal department actively pursues and shuts down scam artists as well.

    You need to come up with a legitimate Plan B. Should the effort to get a modification fail, you do need to have a backup plan to prevent losing the home. For many people this has meant filing bankruptcy, so you may want to consider speaking with an attorney just in case.

    Tim,

    I have been submitted to the bank and have a IBR plan for my student loan of 0 dollars monthly however the are using 1200 payment which now has cause a DTI flag and a suspended account I see on the forum you had advised other this type of payment could be used I am about to lose 1600 dollars and have giving my notice to move I need some help please
