We put in our first offer this weekend after 3 weeks of searching. We had a verbal accepted offer from the sellers. Ernest money was agreed on, property specific letter was drafted and offer was signed by us. They requested a letter of approval to show we can afford the home. This was sent by our realtor. They decided to reject our offer after seeing that naca manages our loan. This is the sole reason they are pulling out. Very disappointing

If they have explicitly stated they won’t work with a naca member for the sole reason of being with naca then that is in direct violation of the fair housing act is considered housing discrimination and they are facing federal charges.

    Hello cjax,

Unfortunately, Nelsont is not correct with his answer. Unless there is direct evidence that the rejection is in fact based on discriminatory reasons as outlined in the Fair Housing Act, such as race, religion or national origin, rejecting the offer based on who your mortgage lender is does not violate the law.

It has been known to be used as a “loophole”, since the vast majority of NACA buyers are low to moderate income and/or minorities, but unless you can prove it’s for a different reason, it’s perfectly legal to reject an offer based on who your lender is.
